DISCLOSURE STATEMENT UNDER THE PERSONAL DATA PROTECTION LAW

As Diyetçim, in our capacity as data controller under Personal Data Protection Law No. 6698 ("KVKK"), we would like to inform you about the processing of your personal data.

1. Data Controller

Diyetçim Sağlık Teknolojileri A.Ş. ("Diyetçim") acts as the data controller under the KVKK.

2. Personal Data Processed

The following personal data of yours is processed through our platform:

Identity information: First name, last name
Contact information: Email address, phone number, address
Health data: Height, weight, body measurements, medical conditions, diet plans (for clients only)
Professional information: Diploma number, specialty area, company information (for specialists only)
Business information: Tax number and tax office (for specialists only)
Package and session tracking details: package name, duration, service types and remaining sessions
Usage data: Login dates, platform usage information

3. Purposes of Processing Personal Data

Creating and managing the membership record
Establishing and managing the specialist-client relationship
Creating and tracking the nutrition plan
Appointment management and reminder services
Tracking health data and progress reporting
Specialists tracking client packages and session credits
Fulfilling legal obligations
Ensuring platform security

4. Legal Basis for Processing Personal Data

Your personal data is processed based on the legal grounds of your explicit consent, performance of a contract, legal obligation, and legitimate interest. Health data is processed only with your explicit consent.

5. Transfer of Personal Data

Your personal data may be transferred to authorized public institutions and organizations and to our technical service providers (server, notification, and security infrastructure) in line with legal obligations and service requirements. Your health data is shared only with the specialist you have approved.

6. Rights of the Data Subject

Under Article 11 of the KVKK, you have the following rights:

To learn whether your personal data is being processed
To request information if your personal data has been processed
To learn the purpose of processing personal data and whether they are used in accordance with that purpose
To know the third parties to whom your personal data is transferred domestically or abroad
To request correction of your personal data if it has been processed incompletely or incorrectly
To request the deletion or destruction of your personal data within the framework of the conditions set out in Article 7 of the KVKK
The right to object to a result against you arising solely from the analysis of your processed data exclusively through automated systems
The right to demand compensation for damages in the event that you suffer harm due to the unlawful processing of your personal data

7. Data Security

Your personal data is protected through technical and administrative measures. Your data is transmitted via encrypted communication protocols (SSL/TLS) and stored on secure servers.

DIYETÇIM PLATFORM TERMS OF USE

By registering for the Diyetçim platform (the "Platform"), you agree to the following terms. Please read them carefully before registering.

1. Service Description

Diyetçim is a free software service that enables specialists to manage clients, appointments, diet plans, measurements, packages, and sessions digitally. The platform does not provide nutritional counseling or medical advice; it is solely a tool for managing the relationship between the specialist and the client.

2. Membership and Account Security

You are obliged to provide accurate, up-to-date, and complete information during registration.
You are personally responsible for the security of your account's password and login credentials.
You are responsible for all transactions carried out through your account.
In the event of suspected unauthorized access, you must notify Diyetçim immediately.

3. Obligations of the Specialist

You declare that you hold a valid specialist diploma and the relevant professional competence.
You are exclusively responsible for the quality and accuracy of the service you provide to your clients.
You may use client health data solely for service purposes and may not share it with third parties.
You are obliged to ensure that your company and tax information is up to date and accurate.
Diyetçim cannot be held responsible for the medical/nutritional advice you provide to clients through the platform.

4. Free Access

The platform is free for specialists, businesses and clients.
There are no locked features or usage limits inside the platform.

5. Prohibited Uses

The following behaviors are strictly prohibited and may result in the suspension or closure of your account:

Entering false, misleading, or fraudulent information
Attempting unauthorized access to another user's account
Using the platform with automated tools or for malicious purposes
Uploading content that infringes copyright or intellectual property
Behavior involving harassment, insults, or threats directed at other users
Providing health advice that violates legal regulations

6. Suspension and Termination of the Account

Diyetçim reserves the right to suspend or terminate, without prior notice, any account it finds to be in violation of the terms of use.

7. Disclaimer of Liability

The Platform is provided "as is"; uninterrupted or error-free operation is not guaranteed.
Diyetçim is not a party to disputes between the specialist and the client.
The accuracy of medical advice, the suitability of diet plans, and client health outcomes are the responsibility of the specialist.
Diyetçim cannot be held responsible for indirect damages arising from communication through the platform.

8. Use of Data

The data you upload to the platform is processed for the purposes set out in the KVKK Privacy Notice. To exercise your rights as a data subject, you may apply to [email protected].

9. Changes

Diyetçim may unilaterally update the terms of use when necessary. Significant changes are announced to users via email or in-platform notification. Your continued use of the platform after the changes are published means that you accept the updated terms.

10. Applicable Law and Competent Court

These terms are governed by the laws of the Republic of Turkey. In the event of any dispute, the Istanbul Courts and Enforcement Offices have jurisdiction.
